    TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HAMEHA, XIM., JSC, OR THEIR DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

    • Loss of profits, data, use, goodwill, or other intangible losses
    • Personal injury or property damage resulting from your use of the Site
    • Unauthorized access to or use of our servers or any personal information stored therein
    • Any bugs, viruses, or harmful code transmitted through the Site

    IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED ONE HUNDRED DOLLARS ($100 USD) OR THE AMOUNT YOU PAID TO US IN THE PAST SIX MONTHS, WHICHEVER IS GREATER.

    This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Hameha has been advised of the possibility of such damage.

    Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

    10. Indemnification

    You agree to defend, indemnify, and hold harmless Hameha, XIM., JSC, and their respective officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

    • Your violation of these Terms
    • Your use of the Site
    • Your User Content
    • Your violation of any rights of another party

    11. Copyright Infringement

    11.1 DMCA Compliance

    We respect the intellectual property rights of others. If you believe that material on our Site infringes your copyright, please provide our Copyright Agent with the following information:

    • Identification of the copyrighted work claimed to have been infringed
    • Identification of the material that is claimed to be infringing and where it is located on the Site

    12. Termination

    We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

    Upon termination, your right to use the Site will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

    13. Governing Law and Jurisdiction

    These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law provisions.

    However, if you are accessing the Site from the United States, any disputes arising out of or relating to these Terms or the Site may also be subject to U.S. federal law where applicable.

    Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Hanoi, Vietnam, and you hereby irrevocably consent to the personal jurisdiction and venue therein.

    14. Dispute Resolution

    14.1 Informal Resolution

    Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@hameha.com. We will attempt to resolve the dispute informally within 60 days.

    14.2 Arbitration

    If we cannot resolve the dispute informally, any disputes arising out of or relating to these Terms or the Site shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration body, except where prohibited by law.

    14.3 Class Action Waiver

    You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

    15. Severability

    If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. The invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision.

    16. Entire Agreement

    These Terms, together with our Privacy Policy and any other legal notices published by us on the Site, constitute the entire agreement between you and Hameha regarding your use of the Site.

    17. Waiver

    No waiver by Hameha of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

    18. Assignment

    You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void.

    We may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties and their respective successors and permitted assigns.

    19. Language

    These Terms are written in English. To the extent any translated version conflicts with the English version, the English version shall control.
